We are able to advise either landlords or tenants on lease renewal proceedings whether they are conducted formally under the Security of Tenure provisions of the Landlord & Tenant Act 1954 or informally on a contracted out tenancy.
We have advised clients throughout proceedings including preparing expert witness reports for Arbitrators to determine the rent and expert witness statements for Court and we have experience in attending Court hearings to provide expert evidence.
Our lease renewal clients have included Arriva Yorkshire Ltd, Wakefield Independent School and Jolliffe Cork LLP Accountants.
We are able to advise either from the position of tenant or landlord on rent review matters from providing initial advice, serving a rent review notice, through the negotiations and creating rent review memoranda documents once agreement has been reached.
We also have experience in advising clients where rent reviews have been submitted to a third party judgement (i.e. an Independent Expert or Arbitrator has been appointed to determine the rent).
Our rent review clients have included Arriva Yorkshire Ltd, Precious Holdings Ltd and a number of local landlords and tenants.
Schedules of Condition / Schedules of Dilapidations
We are able to prepare Schedules of Condition for prospective tenants in order to aid in limiting repairing obligations during a lease. These inspections and reports are extensive as they do not just comment on any defects but record the condition of all parts of the property at the time of the survey, whether they are good or bad.
We are also able to prepare both interim and final/terminal Schedules of Dilapidations. These inspections focus on breaches of the lease. We have provided these for landlords but also occasionally for tenants who wanted to identify and complete works to repair their properties prior to the end of the lease in order to avoid any claim by the landlord.
Our clients in these matters have included Parkin International Ltd (Trinity Business Park), H. Hofmann & Sons Ltd, The Wakefield Welding Centre Ltd.
We are able to market commercial property for sale or to lease and, as required by the regulations, we are registered with HMRC for anti money laundering supervision.
We have experience in all aspects of agency from providing inital marketing advice, producing brochures and marketing, conducting viewings, negotiating with prospective parties, drawing up Heads of Terms, assisting solicitors with enquiries and we are also able to produce licence documents and short term leases for less than 3 years based on the RICS lease templates.
Our experience includes acting on the acquisitions for Trinity Walk in Wakefield, the Bus Station in Wakefield - including agreeing the lettings of the retail units and recently added market stalls, as well as a variety of industrial and commercial properties for local landlords.
Andrew provides an Arbitration service having successfully completed the RICS Diploma in Arbitration and is a member of the Chartered Institute of Arbitrators.
In addition to the usual disputes on rental values Andrew is able to arbitrate on any other commercial property dispute.
We have substantial experience in advising clients on Business Rates issues including carrying out surveys and inspections to estimate correct Rateable Values, advising on appeals and supporting clients through appeals including attending Valuation Tribunal Hearings.
We have advised clients on correcting Rateable Values, the most significant being Havana Nightclub in Wakefield which we reduced from £54,000 to £27,750 Rateable Value from 01/04/2010 and also on deleting assessments or advising of changes such as partial disposals or refurbishment works.

We are able to provide management advice including undertaking lease compliance inspections, assisting in the invoicing and collection of payments and service charges for Landlords and providing advice on these matters to Tenants.
